Agreement

The terms and conditions set out in this document, together with any visual, verbal or written information that we have indicated before confirming your reservation, constitutes the agreement between "you" and "RidePatagonia", with respect to each and every one of the reservations, tours and transactions made with us. Take the time to read and understand the conditions before booking your mountain bike adventure with RidePatagonia, as they establish our respective rights and obligations. We recommend for your experience that you also read all the details set out on the website related to your trip before booking to make sure you understand the itinerary and the style of the adventure you are undertaking.

When making group reservations, the first person named in the reservation accepts on behalf of all the persons detailed in the reservation that:

  • He / she has read these terms and conditions and has the authority to make the reservation and agrees to be under such conditions;

Validity

Information and Booking conditions

To make your reservation, you must pay a non-refundable deposit of 25% of the cost of the chosen trip.

Fullday and Halfday Trips If your reservation is made within 30 days before the departure date, then payment must be made for the total amount at the time of booking.

Travel 3 days or more: If your reservation is made within 30 days before the departure date, then payment must be made for the total amount at the time of booking. The prices indicated are based on the "shared" accommodation and may be subject to change without prior notice. A supplement will be charged for the occupation of a single room if necessary.

You will be sent a kit list and information on how to travel to the meeting point once we receive your deposit / full payment. The instructions for the meeting and the final travel arrangements will be sent two weeks before the start date of your trip.

Your details

In order for us to confirm your mountain bike experience you must provide the full name according to your passport, date of birth, nationality, passport number, and expiration date, any pre-existing medical condition you have that may affect your ability to complete your visit . Travel arrangements and any food restrictions you may have such as allergies, intolerances or if you are a vegetarian. Your reservation can not be confirmed without the provision of these details.

Confirmation of reservations and service contract

Your reservation will be confirmed after we have received the full payment for your trip and you have received our final written confirmation. Together with the confirmation of your reservation, we will confirm the details of your adventure, which will immediately become the agreement between you and us. You must read this confirmation carefully and you must inform us immediately of any error or incorrect term that you think may occur, since the changes cannot be made during the trip and may affect your rights if you do not notify us of any error in your reservation.

Documentation prior to departure

You must carefully read all the documents you receive from us related to the trip. It is your responsibility to contact us if any information is incorrect. We cannot accept responsibility if you do not notify us of inaccuracies within one week of receipt of such documents. This agreement, an "Exemption from Liability" and a "Risk Agreement" and a medical statement must be presented by you. If you do not present this and other necessary documentation prior to departure, we reserve the right to treat your reservation as canceled by you and impose the cancellation fees described in this agreement.

Price of your trip

We can correct the price of the unsold Adventures at any time and correct the errors in the prices of the confirmed holidays.

The price of your confirmed holidays can change at any time in:

  • The fees, taxes or fees charged for services such as landing taxes or boarding or disembarkation rates at ports and airports; or

  • The exchange rates used to calculate your trips.

In case of changes in the used cups you will not be charged any increase if this increase is less than 1% of the price of your trip; excludes insurance premiums and any charges for amendment and / or additional services or travel arrangements made by you. No changes will be made in the price of your confirmed trips within 30 days prior to your departure nor will they be refunded during this period.

Cancellation by yourself of confirmed reservation

If you or any other member of your group decides to cancel your confirmed reservation, you must notify us in writing. We do not offer any refund for the money paid by you in the event that you cancel your reservation.

If it is removed, or has to be withdrawn during the trip for any reason after it has begun, we will not make any refund for the unused services. There are no exceptions to this cancellation policy, including for reasons related to weather, accidents, family or medical emergencies, civil conflicts or any other circumstance beyond our control.

If you or a member of your group can not travel, that person can transfer your place to another person notifying us at least 15 days before departure and you will pay an amendment fee of USD75 per person transferring, it will cover all costs and charges incurred by us and / or incurred or imposed by any of our suppliers and the transferee accepts these booking conditions and all other terms of the contract between us. If you cannot find a replacement, the established cancellation charges will apply to cover our estimated costs. Otherwise, refunds will not be granted for passengers who do not travel or for unused services.

Amendments made by you

If you wish to change any part of your reservation after our confirmation has been issued, you must inform us in writing as soon as possible. This must be done by the first person named in the reservation. Although we will do our best to help, we cannot guarantee that we can comply with your requested change. When we can comply with an application, all changes will be subject to the payment of an administration fee of usd75 per person per change, as well as additional costs incurred and any costs or charges incurred or imposed by any of our suppliers. If we cannot assist you and do not wish to continue with the original reservation, we will treat this as a cancellation on your part. If you cannot travel, you may transfer your reservation to another appropriate person, as long as a written notice is sent. An administration fee will be charged.

If you notify us of any modification less than 30 days before the proposed departure date, the refund policy applicable to cancellations will apply. No amendments are allowed to your reservation within 10 days of departure.

If any member of your group can not travel, that person can transfer your place to another person (presented by you and fulfilling all applicable conditions to the agreements) provided that we are notified at least 30 days before the proposed departure date and you pays an amendment fee of usd75 per person transfer, meet all costs and charges incurred by us and / or incurred or imposed by any of our suppliers and the recipient accepts these booking conditions and all other terms of the contract between us.

Note: Some arrangements cannot be modified after they have been confirmed and any alteration or cancellation could incur a cancellation fee of up to 100% of the part of the arrangements, in addition to the previous charge.

Cancellation by RidePatagonia

It is unlikely that we will have to make changes to your travel arrangements, but if necessary we reserve the right to do so at any time. Most of these changes will be minor and we will notify you or your travel agent as soon as possible. We also reserve the right, in any circumstance, to cancel your travel arrangements. For example, due to natural disasters, terrorism, political instability or other external events, or if it is not viable for us to operate the planned itinerary and / or if the minimum number of participants required for a particular travel agreement is not reached.

Most modifications will be minor and, although we will do our best to notify you of any changes as soon as possible if there is a time before your departure. "Minor changes" include the following when they are made before departure:

  • A change in departure time or the total duration of your trip of twelve hours or less;

  • A change of accommodation to another of the same standard or classification.

Occasionally, we may have to make a major change to your confirmed arrangements. The "major changes" include the following, when performed before departure:

  • A change of accommodation area for all or a significant part of your time away;

  • A change of accommodation to a standard or lower classification for all or a significant part of your free time;

  • A change in departure time or the total duration of your arrangements of twelve or more hours;

  • A significant change in your itinerary, omitting one or more destinations altogether.

If we have to make a major change or cancel the trip, we will inform you as soon as possible to do so before departure.

We will not pay you compensation when we make a major change or cancel before departure; or in the event that we are obliged to make a change or cancellation as a result of unusual and unforeseeable circumstances beyond our control, whose consequences we could not have avoided even with due care; or if we cancel your arrangements because the minimum number of participants has not been reached to execute the arrangements.

The foregoing establishes the maximum scope of our responsibility for changes and cancellations, and we regret not being able to cover the expenses or losses that may be incurred as a result of changes or cancellations, including unforeseen expenses that may have been incurred as a result of your reservation, including, but not limited to, visas, vaccinations, excess travel insurance or non-refundable flights, train or bus tickets.

We will not pay you compensation if we make a minor change or cancel as a result of not having made the full payment on time or when the change or cancellation on our part occurs due to changes in the confirmed reservation you requested.

On very rare occasions, we may be forced by "force majeure" (see below) to change or finalize your arrangements after the game. If this situation occurs, we regret that we cannot make any refund (unless we obtain one of our suppliers) or pay compensation or cover the costs or expenses incurred as a result.

If we cannot complete a significant proportion of the services you have booked with us after your departure, we will make alternative arrangements at no additional cost and, if applicable in all circumstances, we will pay you reasonable compensation.

Errors and omissions

Even though we have made every effort to verify the accuracy of the statements included in the documentation of our trip, including the brochure and the website, we are not responsible for any errors, omissions or unintentional misrepresentation that may occur in the process and We reserve the right to correct prices and other details if you notice that it has happened. You should check the current price and all other details related to the arrangements of your trip before confirming your reservation.

'Force majeure'

RidePatagonia will not be considered in breach of this agreement nor will be liable to you, because of the delay in compliance or failure to comply with any of its obligations under this agreement to the extent that such delay or failure is due to any force greater. 'Force majeure' means any circumstance beyond the reasonable control of RidePatagonia, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, storm, strong wind, fire or accident, war or threat of declared or undeclared war, sabotage, civilians, riots, labor strikes, requisition, disease, quarantine, government intervention, weather conditions and unforeseen circumstances. The advice of the foreign office to avoid or leave a particular country can constitute a force majeure.

If RidePatagonia and / or any of its suppliers are affected by force majeure, they will be entitled and may, at their discretion, vary or cancel any itinerary or agreement in relation to the route. With respect to civil unrest, once RidePatagonia has investigated the prevailing situation, as it deems appropriate, it will remain at the sole and absolute discretion of RidePatagonia to continue with the tour.

Acceptance of risks and responsibilities as a tour participant

You recognize that the nature of a mountain bike trip is adventurous and participation involves a degree of personal risk. You will visit places where geographical attributes present dangers and physical challenges probably greater than those present in your daily life. However, despite this, it is also your responsibility to familiarize yourself with all possible relevant travel information and the nature of your itinerary, and you acknowledge that your decision to travel is made in light of the consideration of this information and that you assumes the inherent risk in such a trip.

It also clearly recognizes and understands that certain risks and dangers may occur during the course of the trip, including, but not limited to, the dangers of traveling in mountainous regions and that due to the very nature of the activities it is exposed to an element of personal risk. In addition to those associated with conventional vacations. You agree to assume all risks associated with the trip and agree that no liability will be attached to RidePatagonia with respect to death, personal injury, illness or delay of the participant, or for any loss or damage to the participant's property, including your bicycle or other cycling equipment, during the course of the trip.

In addition, you must be fit and competent to carry out the itinerary established in the route you have chosen. Therefore, it accepts the risks inherent to the implementation of this contract and accepts as reasonable the limitations of our liability as established in these terms and conditions. You will be asked to read and sign an exemption form before starting your tour. This will be part of your contract with RidePatagonia.

RidePatagonia reserves the right to refuse, accept or retain any person as a member of any group at any time.

Nothing in this clause or in any part of these terms and conditions is intended to exclude or limit the liability of RidePatagonia for death or personal injury caused by our negligence.

Years

Minimum: General Policy - for most of our trips, the minimum age is 18 years. In exceptional circumstances, we can allow children under 18, accompanied by a responsible adult, to join one of our tours. This decision will be at the discretion of RidePatagonia.

Maximum: General Policy - for most of our trips we have no age limit, although we remind you that our trips can be physically challenging.

Disabilities and medical problems

We are not a company specializing in holidays with disabilities, but we will do everything possible to meet any special requirements you may have. If you or a member of your group has a medical problem or disability that may affect your participation in the arrangements, please provide us with all the details before confirming your reservation so that we can advise you on the suitability of the arrangements you choose. . In certain circumstances, we may require you to present a medical certificate certifying that you are able to participate in the tour. Acting reasonably, if we can not adequately meet the needs of the affected person (s), we will not confirm your reservation or if you did not provide all the details at the time of booking, we will cancel and impose charges cancellation corresponding.

Must be in proper form to cover the distances and undertake the program established in your itinerary. If a client is considered not to be sufficiently fit, healthy, properly equipped or able to complete the course without affecting their safety, comfort or happy progress, the leader of the course at any stage has the right to remove it from the course.

Medical treatment: It is a condition of your reservation that in cases of emergency we have your authority to organize the necessary medical or surgical treatments and to sign any form of consent required on your behalf. For this reason you must have travel insurance.

Your behavior

It is expected that all cyclists traveling with us behave in an orderly and acceptable manner, and that they do not interrupt the enjoyment of other participants of the tour. If in our opinion or in the opinion of your travel leader, any hotel manager or any other person in authority, your behavior or that of any member of your group is causing or is likely to cause distress, danger or discomfort to any of you. Our other guests or any third party or property damage, or to cause a delay or deviation to the tour or other means of transport, we reserve the right to terminate your booking agreements with us immediately. In the event of such termination, our liability to you and / or your party will cease and you and / or your party must leave the tour immediately. We will not have more obligations for you and / or your part. No refunds will be made for lost accommodation or any other service and we will not pay any expense or expense incurred as a result of termination. You and / or your party may also be required to pay for the loss and / or damage caused by your actions and we will consider you and each member of your party jointly and personally responsible for any damage or loss caused by you or any member of your group. The total payment of such damages or losses must be paid directly to the hotel manager or another provider before leaving the hotel. If you do not make the payment, you will be responsible for covering any claim (including legal costs) that is subsequently made against us as a result of your actions, along with all the costs that we incur to file a claim against you. We can not be held responsible for the actions or behavior of other guests or people who have no connection with your booking arrangements or with us.

Team

For full day and half day tours, we will provide a mountain bike, helmet and gloves. For tours of 3 or more days we recommend bringing your own equipment such as protections, backpacks and bicycles.

Special requests

Any special request must be notified to us at the time of booking, for example: Special diet, location of the room, a particular installation in a hotel, etc. Then you must confirm your requests in writing. Although we will do our best to try to organize your reasonable special requests, we can not guarantee that they will be met. The fact that a special request has been noted in your booking request or any other documentation or that has been transmitted to the provider is not a confirmation that the request will be fulfilled. Failure to comply with any special request will not be a breach of contract by us unless the request has been specifically confirmed. We do not accept reservations that are conditioned to fulfill any special request.

Our responsibilities

  • We will accept responsibility for the arrangements we agree to provide or arrange for you as an "organizer" as set forth below. Subject to these booking conditions, if we or our suppliers negligently carry out or do not coordinate the services we are required to provide according to our contract with you, as set forth in your confirmation invoice, we will pay you reasonable compensation. The level of such compensation shall be calculated taking into consideration all relevant factors such as, but not limited to: following the complaint procedure described in these conditions and the extent to which our negligence or that of our employees or suppliers affected the general enjoyment of your trip. Keep in mind that it is your responsibility to prove that we or our suppliers have been negligent if you wish to file a claim against us.

  • We will not be responsible or pay compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description if it results from:

    • the act (s) and / or omission (s) of the affected person (s);

    • the acts and / or omissions of a third party not related to the provision of the services contracted and that were unpredictable or unavoidable;

    • unusual or unforeseeable circumstances beyond our control or that of our provider (s), whose consequences could not have been avoided even if due diligence had been provided; or

    • an event that we ourselves or our suppliers could not, even with due diligence, have anticipated or hindered.

  • We limit the amount of compensation that we will have to pay if we are responsible according to this clause:

    • Loss and / or damage of any luggage or personal belongings and money: The maximum amount that we will have to pay you in relation to these claims is an amount equivalent to the excess in your insurance policy that applies to this type of loss per person in total, because it is assumed that you have adequate insurance to cover any loss of income. this type.

    • Claims that are not included in a) above and that do not involve injury, illness or death: The maximum amount that we will have to pay you with respect to these claims is equal to the price paid by or on behalf of the affected person (s) in total. This maximum amount will only be paid when everything went wrong and you or your group have not received any benefit from your reservation.

  • It is a condition of our acceptance of liability under this clause that we notify any claim to ourselves and our provider (s) strictly in accordance with the complaint procedure set forth in these conditions.

  • When a payment is made, the person (s) receiving it (and your parent or guardian if you are under 18) must also assign to us or our insurers the rights they may have to seek a third party and must provide ourselves and our insurers with all the assistance we can reasonably require.

  • Please note that we can not accept any responsibility for damages, losses or expenses or other sums of any description: a) that on the basis of the information you provided us with respect to your reservation before accepting it, we could not have foreseen that would suffer or incur if we breached our contract with you; or b) relate to any business.

  • We will not accept responsibility for services or facilities that are not part of our agreement or where they are not advertised in our brochure. For example, any excursion that you reserve while you are traveling, or any service or facility that your hotel or any other provider agrees to provide.

Travel insurance

Travel insurance is mandatory for all RidePatagonia travelers and must be withdrawn at the time of booking. Your travel insurance must provide coverage against personal accidents, death, medical expenses and emergency repatriation. We also strongly recommend that you cover cancellation, reduction, personal liability and loss of luggage and personal effects. You must present proof of your travel insurance the first day of your trip; You will not be able to join the trip without him. If you choose to travel without adequate insurance coverage, we will not be responsible for the losses that arise, for which insurance coverage would have been available.

Passport and visas

You are responsible for ensuring that all necessary travel documents are valid and effective and are in your possession throughout the journey. Passports for non-Chilean participants are required to travel and must be valid for at least six months after the return date. We suggest that you request or renew your passport in advance. Other required documents may include visas, permits and vaccination certificates. You assume full responsibility to verify and verify any passport, visa, vaccination or other entry requirements. You are also solely responsible for the adverse consequences arising from incomplete or defective documentation. While we may provide information or advice on matters such as visas, vaccinations, weather, clothing, luggage and special equipment in good faith as a courtesy to you, we are not responsible for any errors or omissions in the information provided. We do not accept any liability if you can not travel or incur any other loss because you have not complied with your passport, visa, immigration requirements or health procedures. You agree to reimburse us in connection with any fine or other loss that we incur as a result of your breach of any passport, visa, immigration requirements or health procedures.

Flexibility

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and must take into account the alternatives. The itinerary planned for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to modifications without prior notice due to circumstances or local events.

Change of itinerary

While we strive to operate all trips as described, we reserve the right to change the itinerary of the trip. Check our website before departure for the most recent updates to your itinerary.

After departure: We reserve the right to change an itinerary as a result of weather, local circumstances or events beyond our control. In such emergency circumstances, the additional cost of the necessary itinerary modifications will be covered by you: consult the travel notes of your trip to know the details of the emergency funds you agree to carry for your use in such cases. In this case, we are not responsible for unforeseen expenses that may be incurred as a result of the change of itinerary, such as visas, vaccinations or non-refundable flights.

Authority on tour

Our group trips are in charge of a RidePatagonia guide certified by WFR or another homologous. The guide's decision is final in all matters that may affect the safety or well-being of any person who participates in the trip. If you do not comply with a decision made by a guide or interfere with the welfare of the group, the guide may order you to leave the trip immediately, without reimbursement. In such circumstance, when a traveler is removed from the trip, RidePatagonia accepts no responsibility for their transfer back to the end point of the trip or the costs incurred in the trip. Any transport organized for the traveler in question will be at the sole discretion of RidePatagonia.

We can also choose not to take it on future booked trips. You must comply at all times with the laws, customs, currency exchange and medication regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.

Complaint procedure

If you have a complaint during your trip, you should notify RidePatagonia or your problem guide immediately so they can try to resolve the situation. If you do not do so while on tour, your ability to claim compensation from us will be extinguished. In addition, if you try to resolve the problem on your own without using this notification procedure, you assume responsibility for the additional costs that you may incur and you will lose any possible reimbursement.

If you are not satisfied after using this notification procedure, you must send your claim in writing to RidePatagonia within 14 days of the end date of the trip.

Start date of the tour

It is your responsibility to be ready to undertake the journey as specified in the itinerary. RidePatagonia is not responsible for losses due to canceled or lost flights, modified flight itineraries, late arrivals or early departures. Our responsibilities do not start until the appointed time at the designated meeting point.

Flight delays

If you or any member of your group loses your flight or other means of transportation, is canceled or is subject to a delay of more than 3 hours for any reason, you should contact the airline or other transportation provider directly and immediately. As we do not offer flights or other means of transportation as part of our program, we have no responsibility with respect to such delays or cancellations. However, any airline or other transportation provider may pay for or provide new flights, refreshments and / or adequate accommodations and must file a claim directly with them.

Release of use of images

You agree that RidePatagonia may use, reuse and reproduce any image, photograph or video that you send to us, or that are taken by our guides and / or other participants of you individually or in a group, in any medium, including, but not limited to, media. printed, electronic or internet, free of charge and without your right of inspection, to promote and advertise our products and travel services around the world. If you do not want us to use your images taken by us or other participants during the tour, you must inform us or the leader of your written tour at the beginning of the tour.

Privacy Policy

Any personal information we collect about you (contact) may be used for any purpose associated with the operation of a trip or to send you marketing material in connection with our events and special offers. The information can be disclosed to our agents, service providers or other providers so that we can operate the trip. Otherwise, we will treat your data with strict confidentiality and will not be sold in any way to third parties.

Conditions of the suppliers

Many of the services that make up your vacation are provided by independent providers. These providers provide these services in accordance with their own terms and conditions. These providers offer these services in accordance with their own terms and conditions that will be part of your contract with us. Some of these terms and conditions may limit or exclude the provider's liability to you, generally in accordance with applicable international conventions. Copies of the relevant parts of these terms and conditions are available at the request of us or the supplier involved.

Applicable law

The laws of Chile govern these terms and conditions to the fullest extent permitted. Any dispute related to a trip or these terms and conditions must be initiated in the courts of Chile and both parties submit to the exclusive jurisdiction of the Chilean courts.
